1. Your agreement to these terms
By accessing or using toothhurt.com (the "Site"), you agree to these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the Site.
You also agree to our Privacy Policy, which is part of these Terms by reference.
You must be at least 18 years old, or have your parent's or guardian's involvement, to submit a form on the Site.
2. What our service is (and isn't)
The Site is operated by Tooth Hurt LLC ("Tooth Hurt," "we," "us," or "our"). We are a California limited liability company providing a marketing service that connects people seeking dental care with participating, independently owned and licensed dental offices.
When you submit a form on the Site, we share the information you provide with a participating dental office in your area, so that office can contact you about scheduling an appointment. Submitting a form does not schedule an appointment. A participating dental office may or may not contact you. We do not guarantee that any particular dental office will contact you, that an appointment will be made, that any particular service will be provided, or that any particular outcome will result.
3. How you can use the site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Submit information about anyone other than yourself, except where you are authorized to do so on that person's behalf.
- Submit false, misleading, or fraudulent information.
- Use the Site in any way that violates any applicable federal, state, local, or international law.
- Attempt to interfere with the proper working of the Site, including by introducing viruses, attempting to gain unauthorized access, or scraping data in a manner that exceeds normal use.
- Use any automated means to submit forms, including bots or scripts.
- Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any part of the Site without our express written permission, except as permitted by these Terms or applicable law.
4. Your form submissions
By submitting a form on the Site, you represent and confirm that:
- The information you have provided is true and accurate to the best of your knowledge.
- You are submitting the form on your own behalf, or you are authorized to submit it on behalf of the person whose information is being submitted.
- You consent to having your contact information and the general nature of your inquiry shared with a participating, independently operated dental office in your area for the purpose of that office contacting you to schedule an appointment.
- You understand that we are not a dental practice and that submitting a form does not establish a dental, medical, or other professional relationship with us or with the participating dental office.

5. Medical emergencies
Examples of situations that may require emergency care include severe swelling in your face, jaw, or neck; high fever; uncontrollable bleeding; or difficulty breathing or swallowing. The Site is not designed for, and is not appropriate for, emergencies.
6. Dental offices are independent
Participating dental offices are independent third parties. They are not owned, operated, controlled, or employed by Tooth Hurt LLC. We do not control their clinical practices, scheduling, pricing, billing, insurance acceptance, services offered, or any other aspect of how they operate.
Any agreement, appointment, treatment, or transaction you enter into with a participating dental office is between you and that office. Tooth Hurt LLC is not a party to that relationship and is not responsible for the dental office's actions, services, advice, or outcomes.
Each participating dental office maintains its own privacy practices, terms, and clinical standards. If a dental office contacts you, your relationship with that office is governed by its own practices.
7. Intellectual property
The Site, including its design, text, graphics, logos, and software, is owned by Tooth Hurt LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. The "toothhurt.com" name and logo are trademarks of Tooth Hurt LLC.
You may view and print pages of the Site for your own personal, non-commercial use. Any other use, including reproducing, distributing, or creating derivative works, requires our prior written permission.
8. Third-party services and links
The Site uses third-party services, including those provided by Google (Google Analytics, Google Ads, Google Apps Script). Your use of those services may also be subject to those providers' own terms and privacy policies.
The Site may also include links to third-party websites. Those websites are not under our control, and we are not responsible for their content, accuracy, or practices.
9. Disclaimers
To the maximum extent permitted by law:
- The Site and our service are provided "as is" and "as available" without any warranties of any kind, express or implied.
- We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, and uninterrupted availability.
- We do not warrant that the Site will be error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components.
- We do not warrant that any participating dental office will contact you, that any appointment will be made, that any service will be provided, or that any outcome will result.
- Nothing on the Site is professional advice of any kind. You should not rely on the Site as a substitute for advice from a qualified, licensed professional.
10. Limitation of liability
To the maximum extent permitted by law:
- Tooth Hurt LLC and its members, officers, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, arising out of or in connection with your use of the Site or our service, even if we have been advised of the possibility of such damages.
- Our total cumulative liability arising out of or relating to the Site or our service, regardless of the legal theory, will not exceed one hundred U.S. dollars ($100) or the amount you paid us in the 12 months preceding the claim, whichever is greater.
- We are not liable for the actions or omissions of participating dental offices, including any clinical care, advice, scheduling, billing, or other conduct.
- Some jurisdictions do not allow the exclusion or limitation of certain damages. If you live in such a jurisdiction, the above limitations may not apply to you, and our liability will be limited to the smallest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Tooth Hurt LLC and its members, officers, employees, contractors, and agents from any claim, damages, liability, cost, or expense (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or any false or misleading information you submit.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
Nothing in this section limits your rights as a California consumer under applicable law.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will provide additional notice.
